Wondering if anyone has any insight between these 2 GPUs. Would I be better off getting a used RTX 3090 due to it's increase in CUDA cores and memory over an RTX 4070 TI? Does vMix benefit from a higher memory and CUDA cores?

RTX 3090 has 10496 CUDA cores and 24 GB of memory.
RTX 4070 TI has 7680 CUDA cores and 12 GB of memory.

CUDA cores is the single most important thing in terms of vMix. Go for the highest option you can.

The new option of encoding in AV1 codec is only possible with Geforce Series RTX 40 and following.
